What is your starting psi on the Toyo open country and how high does the psi go after driving. Mine at at 36 cold but after highest driving they go as high as 39 psi. Is this too high?

It's not too high as in unsafe for the tire if that's what you mean.

Even though it came from the factory at 40osi roughly.
Higher air pressure is used when the tires are mounted at the factory to set the tire bead to the rim.
The tire pressure typically isnt reset until PDI is performed at the dealer, even then its hit or miss if the dealer actually checks the tire pressure.
When I purchased my Badlands I was going through the different displays in the dash and noticed the tire pressure was over 40PSI and I asked my sales person to get the service manager to set the pressure correctly before I drove home.
