I will say I don't know anything about this law in Canada, but I don't think the BS can be started with the lights in the off position. It always defaults to Auto, which means the DRL are always on when you start the car. The switch is electronic, not a dial that can be left in a certain position.

When I pack the top I just stand on the back tire and the back seat. If I need more height I fold the back seat down and just stand on it folded and have no issues reaching anywhere. Obviously the persons height plays into this, but the BS isn't that big of a vehicle to access the roof.
