I did not know they went for that much.
If you backed out they’d have to sell it on the lot and be hard pressed to get $38,000 I would think because at that level a buyer would want to customize just like you did.
It has gone up 500.00 dollars since I ordered it. It is a Badlands with premium, 360+,moonroof, cargo management system. I think it's a decent price for today's market. I will get cash back for my trade-in.

Short answer: Yes, they are 100% allowed.
Longer answer: It's their vehicle until you sign for it. If there was a legally binding contract clearly stating and locking in the price signed by the sales manager the day you ordered, you have a bit more of a case against it. There's a lot of trust involved with this process. I will always be adamant that if I didn't absolutely have to order through a dealer, I'd never go through one again. Adding a middleman between the consumer and the manufacturer almost always adds a headache for the consumer rather than making the process more fair/reputable. Dealerships are good for test drives and a service department, and that's where my admiration ends.

I have a question, everyone! With all the mark-ups on vehicles going on all across the country at dealerships, can dealerships place a "market adjustment" on a custom factory ordered Bronco Sport? This is something that I'm trying to find out before I take the next step in the purchase process. These mark-ups are a really ridiculous scam, if you ask me! Anyways, thanks to whoever can give me, and everyone else on this forum who's been thinking about this exact question, an answer! Have a great day to everyone who reads this post!
My wife ordered her BS OB in the beginning of March 2021 and received it at the end of September 2021. The price increased as Ford adjusted prices on her options but the dealer honored the "A" plan discount I receive. We did not put any money down or sign anything. I never had a concern the dealership we shop at would not honor the "deal". They did tell me if I would of backed out they would have marked up the price. There is a dealership closer to our house I driver by daily that I would not trust to give me change for a twenty dollar bill.
Good luck the BS is well worth it.

You should pay what it was when you originally ordered it. Your dealer will (should) know this.

Your dealer should not have adjusted your prices if the order had your name on it. Only if it were for stock. The “A” plan has no effect on this. I’ve done this for years through Ford. Once you order it, the price is based on the day it was submitted unless you added or changed options after your order was placed and the price increases.

What I'm trying to find out is, if the dealership(s) are allowed to put a "Market Adjustment," aka, markup, on a custom factory ordered BS, or any custom ordered vehicle, for that matter? The answer to this question is what I'm looking for! And again, I would like to thank everyone for all of your responses to this topic! Have a GREAT day, everyone!
They can do what ever they want but…. If you ordered it as a custom order, the price you were quoted is the price Ford will honor. What the dealers does is entirely up to them. Just don’t let them lead you to believe it’s Fords issue because it is not.

For your security if you have an offer signed by the store it certainly helps protect you. We do not do that as a practice unless a customer requests it. We've always stood behind our word as well.
