Yes, and if you keep reading Mom told the police she didn't think her husband had seen her waving at the baby in the back seat. They also had a five-year-old at the time whom Mom had taken to school. She had the baby with her. Mom was supposed to drop the baby at daycare, but says she forgot.

Again, I'm not saying there was no negligence, but the main reason these people weren't prosecuted is because there is no evidence of intent. The way I see it, the prosecutor who made that decision had a lot more information than I got from reading a few articles in the paper.
Yep. I just contain a bias for these types of cases admittedly. I guess living with the pain of killing your own child because you’re so “distracted” is enough? I dunno. Oh you were in a hurry? It’s ok. I question it a lot. I mean I check every day that I have my phone and wallet before I leave. Who is not doublechecking they’re kids? What kinds of people are these? Like I said. I contain bias.

I'm with you! My only objection to your original post on this topic was that there were no "accidents" in these cases. I'm not saying they are ALL accidents, just that I don't believe they are ALL intentional. It's tragic, but kids die due to negligence/accidents all the time. I think about that every time I see some driver looking at their phone while they have kids strapped in the back seat.

I think authorities could very easily have garnered a conviction on charges of unintentional homicide based on criminal negligence in the case I brought up, but clearly there was not enough evidence to pursue charges of intentional homicide. I believe part of the decision not to prosecute even for negligence was the reality if these people went to prison it would be like punishing the other child as well.

I don't know if justice was served in this case. My heart says no. My head says I'm glad I wasn't the prosecutor, because I can't think of any decision that would have resulted in a just outcome.
