loose screw

Hello, Has anyone else experienced this issue? The video shows the problem at its worst. I found a loose screw on the rail, and while tightening it made the issue happen less frequently, it hasn't gone away completely. I would really like to get this fixed permanently. Any ideas are welcome.

Does anyone know if the parts warranty covers anything like this? I am guessing I was driving one day and the screw that holds the splash guard (right term) secure and it burned off a corner of it on the tire as I was driving. Is something like this covered under warranty? I just have no clue...
